Educational Advising Services Terms and Conditions

  1. General
    1. These terms and conditions (the “Terms”) govern your use of this website (the “Site”) and your relationship with Academic Pathways.
    2. By using the Site, you confirm and agree that you have read and understand the Terms and agree to abide and be bound by them.
    3. All Academic Pathways content published and made available on the Site (including but not limited to images, text, logos, documents, and downloadable files) is and remains the property of Academic Pathways.
    4. When you create an account on the Site, you confirm and agree that:
      1. you are solely responsible for your account and the security and privacy of your account, including any password and other information, personal or otherwise, provided at or connected with your account;
      2. all information, personal or otherwise, that you provide through or in connection with your account is accurate when given and you will update it if and as needed to maintain its accuracy; and
      3. Academic Pathways has the right to suspend or terminate your account if you violate the Terms.
  2. Purchase and Sale of Services. 
    1. When you purchase services on or through the Site, you are engaging Academic Pathways to provide educational advising services for your child (the “Student”) and you acknowledge and agree that the purpose of such services will be to assist with the Student’s university planning and application process.
    2. Such assistance may include helping you and the Student to (1) identify what characteristics and goals you and the Student have that might be pertinent to selecting suitable university programs for the Student, (2) identify what universities might be good application choices for the Student, and (3) plan for, prepare, complete, and submit the Student’s university applications.
    3. If you purchase a Basic, Standard, Premium, or other Program, Academic Pathways’ services will begin on your payment of the applicable fee (and any applicable tax thereon) and continue until no later than May 1, 2023.
    4. Fees (and any applicable tax thereon) that you pay to Academic Pathways are not refundable.
    5. Academic Pathways’ ability to provide services to you and the Student depends on you and the Student fulfilling your responsibilities and meeting deadlines that Academic Pathways identifies to you.
    6. You acknowledge and agree that:
      1. it is up to each university to decide whether to accept any applicant, so Academic Pathways cannot guarantee that the Student will be accepted by any university; and
      2. although Academic Pathways may assist the Student in identifying application deadlines and planning for the timely completion and submission of applications and may coach the Student regarding writing essays and completing applications, the Student himself or herself is solely responsible for completing and submitting applications by applicable deadlines.
    7. To the maximum extent permitted by law, Academic Pathways’ liability for any loss or damage that you or the Student may claim will be limited to the aggregate amount of fees you pay to Academic Pathways. This limitation will apply regardless of the cause of action or legal theory pleaded or asserted.
    8. The agreement formed on your engagement of Academic Pathways will be governed by the Terms together with the provisions of the contract, if any, that you enter into with Academic Pathways, and the Terms together with any such additional contract will be the entire agreement between you and Academic Pathways, will replace any and all prior discussions and agreements, whether written or oral, express or implied, and will be governed by and construed in accordance with the laws of the Province of British Columbia and Canada.
